Consultation Procedure

The consultation procedure is the original legislative procedure of the European Community. It has however lost much of its importance since the introduction of the cooperation and codecision procedures.

European Parliament and the Economic and Social Committee and, if appropriate, the Committee of the Regions, are consulted on Commission proposals and issue opinions. The Council is not however bound by these opinions when taking its final decision on the legislation. The majority required in the Council depends on the policy area concerned.

The consultation procedure is now only used in cases where the Treaties do not expressly specify that either the cooperation, codecision or assent procedure must be used.
